If you have received a notification letter from the Office of Student Conduct, you are required to attend an informal conference with a conduct professional to discuss a complaint filed against you. The notification letter should include details of the complaint, the Indiana University Code of Conduct violation that will be discussed, and the date/time of your informal conference.

It is required that you attend the scheduled informal conference with the conduct professional. If you do not attend, the conduct professional can make a determination in your absence based on the report that has been provided.

Within the Indiana University South Bend Student Conduct process you have a right to a fair process, the right to be heard, the right to be informed of the complaint and the alleged violation, and the right to request a formal hearing where witnesses may be utilized.

The Office of Student Conduct professionals are prepared to assist students in their success at Indiana University South Bend. It is expected the professionals and students come to the meeting with a respectful and honest perspective. Our process is educational, not criminal in nature.

During the informal conference students will have the opportunity to respond to the allegations that were sent in the notification letter. If found responsible, the student conduct professional and student will discuss what sanctions are appropriate to assist the student in a successful experience at Indiana University South Bend. There are, and will be, instances that will ask us to consider the safety and well-being of students over their choice of the individual. It is our responsibility to keep the campus safe while assisting in the development of those we serve.

If a student and student conduct professional do not reach an agreement during an informal conference with the Office of Student Conduct, the student has the right to request a formal hearing panel to hear the conduct complaint. The formal hearing panel is comprised of Indiana University South Bend faculty, administrators, and students equally. If a student has been heard at a formal hearing and does not agree to the sanctions provided they may request an appeal to the Dean of Students for personal misconduct. Procedures for the appeal process can be found in the Indiana University South Bend Procedures for Personal Misconduct.

Criteria for an appeal of the hearing panel’s decision include:

1. That the student was not afforded due process per the Indiana University South Bend Procedures for Personal Misconduct;
2. That the sanctions imposed were not proportionate to the act of personal misconduct; or
3. That there is new and significant information that affects the finding of responsibility for the act of personal misconduct.

A student appealing the faculty members decision for academic misconduct must appeal to the Dean of the School. Procedures for the appeal process can be found in the Indiana University South Bend Procedures for Academic Misconduct.

1. The student was not afforded due process per the Indiana University South Bend Procedures for Academic Misconduct;
2. The finding of responsibility for the act of academic misconduct failed to meet the preponderance of information standard;
3. The sanctions imposed by the faculty member were not proportionate to the act of academic misconduct.

If you were assigned a sanction from the Office of Student Conduct whether it was an informal conference, formal hearing panel or appeal; it is required that you complete that sanction. Failure to complete a sanction may result in additional sanctions for not complying with university official instructions and include a hold on your record restricting you from registering for classes.

Sanctions are unique to every case; however, the Office of Student Conduct does utilize some of the following sanctions for students.

Indiana University administrative sanctions can include:

• Warning
• Disciplinary Probation
• Suspension
• Expulsion

Educational sanctions to help assist the student and repair harm:

• Alcohol or other drug online education course
• Meeting with an academic advisor or the Academic Center for Excellence
• Restitution for any damages
• Programming assistance for other students
• Student success reflection paper where we will discuss goal planning for graduation and engagement on campus
• Community engagement efforts
• Follow up meetings with a conduct professional to monitor academic and engagement progress goals
